EU AI Act for Hungarian startups: 2026 founder's guide

The EU AI Act has been in force since 2024. The high-risk obligations kicked in mid-2026. Hungarian startups building AI products now have to classify their use case, document compliance, and (for high-risk) register with the regulator. This is what a Hungarian founder actually needs to know - without the regulatory-theatre overspend.

Step 1 · Classify your use case

1. Prohibited (Art. 5) · subliminal manipulation, social scoring, real-time biometric ID in public · don't build these, period
2. High-risk (Annex III) · recruitment / hiring, credit scoring, education grading, critical infrastructure, law enforcement support · most regulated, requires DPIA + audit log + registration
3. Limited-risk (Art. 50) · chatbots, deepfakes, content generation · transparency obligation only · disclose 'this is AI'
4. Minimal-risk · spam filters, recommendation engines, search ranking · no specific obligations

Step 2 · For high-risk: the deliverable list

If your use case is high-risk, you need: (a) a Data Protection Impact Assessment (DPIA), (b) an audit log retained for 6 months minimum, (c) a bias evaluation report against your training data, (d) a human-in-the-loop fallback, (e) a quality management system, (f) registration with the Hungarian competent authority (NMHH partnership for some categories). Most of this can be built into a lean pipeline; the documentation is what regulators check.

Step 3 · For limited-risk: transparency

The cheap one. Just disclose: 'You're talking to an AI assistant.' Show the disclosure on every conversation start, and again on persistent sessions. For deepfakes, watermark + label. For AI-generated content, disclose at the bottom. That's it - about €500-€2,000 of legal review and you're done.

Common mistakes Hungarian founders make

• Assuming 'GDPR-compliant = AI Act-compliant' (false · they're separate frameworks)
• Building the AI before classifying it (architecture changes are expensive in remediation)
• Hiring a Big-4 firm for a limited-risk classification (€80k for what should be €2k)
• Outsourcing the DPIA without keeping the bias-eval evidence in-house (audit problems later)
• Storing audit logs in the same database as the operational data (no separation of duties)

The Hungarian Cyber Act (NIS2 transposition) and the AI Act overlap on cybersecurity for high-risk AI systems. Plan for one combined audit, not two separate ones - auditors who know both can save you 20-30% on time and fees.
